Table of Death Penalty Laws in the Pentateuch

by daniel lance herrick

This is a sidebar for Why Execute Murderers? which was published in the May - June, 2000 issue of The Christian Statesman.

The impression I have formed over some years is that there is a very specific reason for the death penalty in scripture, and that reason is almost completely absent from contemporary discussion of the merits of the death penalty in civil jurisprudence. So, I am trying here to gather a complete list of death penalty law from scripture. That is the first column of the table. If you know of one that I have missed, please tell me about it.

The purpose of the table is to fill in the last column, headed "why". As I start the collation of this table, I expect the reason in that column to always resemble the end of Deuteronomy 13:5:

So shalt thou put the evil away from the midst of thee.

Definition of "Death Penalty Law" for this compilation
The text calls for men to put to death those who commit some offense. There is a passage in Numbers 31 that calls for the people to put some people to death to complete a war. War is outside the issue of the Death Penalty. There are many passages in which the Lord takes direct action to kill someone for some offense. These are outside the issue of the death penalty because they do not call for men to apply the penalty.
